General Terms and Conditions (GTC) – MRM Jewellery

§1 Scope

(1) These General Terms and Conditions (GTC) apply to all contracts between

MRM Jewellery

– hereinafter referred to as “Seller” –

and consumers within the meaning of Section 13 of the German Civil Code (BGB)
– hereinafter referred to as “customer” –

via the MRM Jewellery online shop.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.


§2 Conclusion of Contract

(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

(2) By clicking the “Buy now” button, the customer submits a binding offer to purchase.

(3) The purchase contract is concluded when the seller accepts the order by sending an order confirmation via e-mail.


§3 Prices and Payment Terms

(1) All prices are Final prices .

(2) Due to the small business regulation pursuant to Section 19 of the German VAT Act, no VAT is shown.

(3) Shipping costs will be before completing the order Clearly displayed in the checkout.

(4) The payment methods offered in the shop will be displayed during the ordering process.


§4 Delivery and Shipping

(1) Delivery shall be made to the delivery address specified by the customer.

(2) Delivery time: Unless a different delivery period is specified in the offer, delivery will take place within 5-10 working days after receipt of payment .

(3) Shipping service provider: DHL or a comparable provider.

(4) Transfer of risk: In the case of consumers, the risk of accidental loss or damage to the goods only passes to the customer upon delivery.

(5) No deliveries will be made on Sundays and public holidays.


§5 Retention of Title

The delivered goods remain the property of the seller until full payment has been received.


§6 Right of withdrawal

(1) Consumers have a statutory right of withdrawal.

(2) Details regarding the right of withdrawal are set out in the Cancellation policy  available from the online shop.

(3) Customers may exercise their right of withdrawal View before completing the order and exercise this right by using the cancellation form.


§7 Warranty

(1) The statutory warranty rights apply.

(2) The warranty period is two years from the date of delivery of the goods.

(3) A guarantee exists only if it has been expressly stated in writing.


§8 Liability

(1) The seller shall be fully liable:

  • in cases of intent or gross negligence

  • in case of injury to life, body or health

  • according to the provisions of the Product Liability Act

(2) In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for this type of contract.

(3) The statutory minimum rights of the consumer remain unaffected.


§9 Product presentations

(1) Product images are for informational purposes only. illustrative representation .

(2) Sizes, thicknesses, materials or proportions may differ from the illustrations.

(3) Dimensions, material descriptions and other product information in the product description are decisively .

(4) Color variations may occur due to different screen displays.


§10 Intellectual Property

All content of the shop (texts, images, designs, logos, graphics) is protected by copyright.
Reproduction, modification or use outside legal limits is prohibited without written consent.


§11 Data Protection

(1) The processing of personal data takes place in accordance with applicable data protection regulations .

(2) Further information, e.g. on Cookies, newsletters (Mailchimp/Klaviyo) or social media integration can be found in the Privacy Policy  of the shop.

(3) By using the services, customers declare their consent to the processing of personal data in accordance with this privacy policy.


§12 Applicable Law

(1) The law of the Federal Republic of Germany shall apply.

(2) Mandatory consumer protection provisions of the State in which the customer has his or her habitual residence shall remain unaffected.


§13 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

The seller is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.


§14 Final Provisions

(1) Should individual provisions of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

(2) Amendments or additions must be in writing.
